Terms of Use

Terms governing use of the Management Consultants for the Arts website.

Effective date: October 15, 2026   Last updated: October 15, 2026

Welcome to the website of Management Consultants for the Arts ("MCA," “we,” “us”). These Terms of Use ("Terms") govern your use of mcaculture.com and any page or content that links to these Terms (the "Site"). By using the Site or submitting a form on it, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Site.

About our services; No engagement formed

  • The Site describes our services. Browsing the Site, contacting us, or requesting materials or submitting your information does not create a client relationship, an engagement, or any other contract with MCA beyond these Terms. Engagements are formed only by a written agreement signed by MCA, and if that agreement conflicts with these Terms, the agreement controls.
  • Content on the Site is general information. It is not professional, legal, financial, employment or other advice for your situation. Executive coaching is a professional development service. It is not therapy, counseling or medical or mental health treatment.
  • Candidates and searches
  • Opportunities may change. Information on active searches is posted for candidates' convenience and may change, be filled or close without notice. Submitting interest or materials does not guarantee consideration, advancement, an interview or any employment outcome. Each hiring decision rests with the client organization.
  • Accurate information. You agree that information you submit is accurate and your own, and that you will not misrepresent your identity, qualifications or experience.
  • We never charge candidates. MCA’s fees are paid by our clients. MCA never asks candidates for money, bank details or payment of any kind. If anyone claiming to represent MCA asks you for payment, do not pay, and report it to contactus@mcaculture.com.

Equal opportunity. MCA and its clients are committed to equal opportunity; searches are conducted without regard to race, color, religion, sex, national origin, age, disability, veteran status, sexual orientation, gender identity, or any other characteristic protected by law.

What you submit

You are responsible for the information and materials you submit through the Site ("Submissions"). By submitting them, you:

  • confirm that you have the right to share them. If you nominate someone or give information about another person, you confirm that you have a good-faith basis for doing so and that the information is not confidential to anyone else;
  • give MCA permission to use, copy, store and share your Submissions as needed for the purposes described in our Privacy Policy, such as considering candidates, responding to you and providing our services. This permission does not transfer ownership of your materials;
  • agree not to submit anything unlawful, defamatory, misleading or infringing, or any malicious code.

Unsolicited ideas. If you send us ideas, proposals or creative materials that we did not request, we are free to use them without obligation to you, and they are not confidential. This does not apply to candidate materials or to information shared under an engagement or confidentiality agreement.

Acceptable use

You may not:

  • use the Site in violation of law or the rights of others;
  • scrape, crawl, harvest or systematically download content or personal information from the Site, including by automated means, except search engines indexing public pages in accordance with our robots.txt file;
  • use any content from the Site to develop, train, fine-tune or evaluate artificial intelligence or machine-learning models;
  • attempt to gain unauthorized access to the Site or its systems, probe or test their vulnerability, or interfere with their operation;
  • impersonate MCA, any MCA team member or any other person, or use the Site to solicit candidates under false pretenses;
  • send spam or bulk unsolicited communications through Site forms.

Intellectual property

The Site and its content, including text, design, graphics, photographs and materials such as the MCA Services Catalog, are owned by MCA or used under license, with permission, or because they are in the public domain. They are protected by copyright and other laws.

Your use of our content. You may view, download and share Site content for your own informational, non-commercial purposes, as long as you keep all copyright, credit and other notices intact and do not alter it. You may not republish, sell or commercially exploit it, present it as your own, or create derivative works from it without our written permission. You may not copy, scrape or use Site content to develop or train artificial intelligence or machine-learning models. MCA expressly reserves all rights to the Site’s content for text and data mining.

Content owned by others. Some photographs and other content on the Site belong to our clients, photographers or other third parties and are used under license or with permission. Those owners keep all their rights, and these Terms give you no rights in that content; for any use beyond viewing the Site, you need the owner’s permission. Some images are in the public domain or available under open licenses, and nothing in these Terms limits your rights in those images. Images may show people, artworks, performances or venues. Using an image on the Site does not grant you any rights in what it shows, and it does not mean that anyone shown endorses MCA. Image credits and license details are available on request.

Concerns about content. If you believe content on the Site infringes your copyright or other rights, or uses your image or work without permission, write to contactus@mcaculture.com. Include your contact details, a description of the work or right concerned, and where the content appears on the Site. We will review your concern promptly and, where appropriate, remove the content, add a credit, or obtain permission.

Trademarks

MCA and Management Consultants for the Arts are trademarks of Management Consultants for the Arts. You may not use them without our written permission, except to refer to MCA accurately. Other names and marks on the Site belong to their respective owners. References to clients describe completed or ongoing engagements and do not imply any client’s endorsement of MCA’s services or affiliation with MCA.

Third-party sites and services

The Site links to third-party services, including application forms, video platforms and social media. MCA does not control and is not responsible for their content or practices, and their own terms and privacy policies apply. A link is not an endorsement.

Privacy

Our Privacy Policy explains how we handle personal information and is part of these Terms.

Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, MCA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE WORK TO KEEP THE SITE ACCURATE, SECURE AND AVAILABLE, BUT WE DO NOT WARRANT THAT IT WILL BE COMPLETE, CURRENT, ERROR-FREE, UNINTERRUPTED OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MCA AND ITS PARTNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, OPPORTUNITY, DATA OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain of these limitations, so they apply to you only to the extent the law allows. This section does not limit liability that cannot be limited by law, and it does not apply to services provided under a separate written engagement, which that engagement governs.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless MCA and its partners, employees and agents from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site or your Submissions.

Governing law and changes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising from or relating to these Terms or the Site will be brought exclusively in the state courts located in New Castle County, Delaware, or the United States District Court for the District of Delaware, and you and MCA consent to the personal jurisdiction of those courts. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND MCA EACH WAIVE THE RIGHT TO A JURY TRIAL IN ANY SUCH DISPUTE. Nothing in this section prevents either party from seeking urgent injunctive relief in any court of competent jurisdiction, or limits rights you have under the mandatory consumer laws of the place where you live.

Changes, suspension and termination

We may update these Terms by posting a revised version with a new "Last updated" date. Changes apply from that date and do not apply to disputes that arose before it. Continued use of the Site after a change means you accept it. We may change, suspend or discontinue any part of the Site, or restrict access for anyone who violates these Terms, at any time.

General

These Terms and our Privacy Policy are the entire agreement between you and MCA about the Site, and they replace any prior understanding on that subject. They do not replace any written engagement or confidentiality agreement. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a reorganization or sale of our business. You agree that we may communicate with you electronically and that electronic communications satisfy any requirement that a communication be in writing.
